These terms govern your use of elleithium.com, operated by Elleithium Inc. (“Elleithium”, “we”, “us”), a corporation based in Toronto, Ontario, Canada. By accessing or using this site you agree to them. If you do not agree, please do not use the site.

What this site is

This is an informational and portfolio site for Elleithium Inc. and its two ventures — Elyvator (web design and development) and Hyper (HYROX coaching). Content is provided for general information.

Nothing on this site is an offer, quote, or binding commitment to provide services. Any engagement is governed by a separate written agreement between you and Elleithium.

No professional advice

Content on this site is general information and is not professional advice. You should not rely on it as a substitute for advice from a qualified professional.

This matters particularly for training content. Any material relating to fitness, HYROX preparation, programming, pacing, nutrition or performance is general information and is not medical advice. Consult a qualified physician before starting or changing any exercise programme. Physical training carries inherent risk of injury; you are responsible for your own health decisions and accept those risks.

Intellectual property

The site and its contents — including design, layout, text, graphics, photographs, the Elleithium wordmark and element mark, and underlying code — are owned by Elleithium Inc. or its licensors and are protected by Canadian and international intellectual property law.

You may view this site and print or download individual pages for your own personal, non-commercial reference. You may not otherwise copy, reproduce, republish, frame, mirror, scrape, or exploit any part of it commercially without our prior written permission. All rights not expressly granted are reserved.

Acceptable use

You agree not to:

— use the site for any unlawful purpose or in breach of these terms;

— attempt to gain unauthorised access to the site, its server, or any connected system;

— interfere with or disrupt the site, including by overloading it or introducing malicious code;

— use automated means to scrape, harvest or index content except by well-behaved search engine crawlers;

— misrepresent your identity or any affiliation with Elleithium.

Third-party links

This site links to elyvator.com, trainhyper.com, and external platforms including social media. Those links are provided for convenience. We do not control and are not responsible for the content, terms, availability or practices of any site we do not operate.

Availability and changes

The site is provided on an “as is” and “as available” basis. We may add to, change, suspend or discontinue any part of it at any time without notice. We do not warrant that the site will be uninterrupted, timely, secure or error-free, or that any defect will be corrected.

Disclaimer of warranties

To the fullest extent permitted by law, we disclaim all warranties, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, and any warranty that the content is accurate, complete or current.

Limitation of liability

To the fullest extent permitted by applicable law, Elleithium Inc. and its directors, officers, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to your use of, or inability to use, this site — even if we have been advised of the possibility.

Where liability cannot be excluded, our total aggregate liability arising from or relating to this site is limited to one hundred Canadian dollars (CAD $100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities, so some of the above may not apply to you. Nothing here limits liability that cannot be limited by law.

Indemnity
